MOST IMPORTANT RULE

Legal documents should be reviewed promptly.
If SCILLAN notifies a customer that service of process or another legal document has been received, the customer should:

  1. Access the document promptly.
  2. Review the document.
  3. Note any stated dates or deadlines.
  4. Contact a licensed attorney where legal guidance is needed.
  5. Contact SCILLAN Support if the document cannot be accessed.

HOW SCILLAN NOTIFIES CUSTOMERS

How will I know SCILLAN received something?

SCILLAN's standard Registered Agent notifications are primarily:
Email-based
Applicable documents may also be made available through an approved:

  • Client Portal
  • Secure document repository
  • Document-delivery system

SMS NOTIFICATIONS

Will SCILLAN text me if I'm served?

SCILLAN's standard Registered Agent notifications are not SMS-based.
Customers should maintain an actively monitored email address.

PHONE CALLS

Customers should not rely on a phone call as the standard notification method.
The primary notification method is email.

KEEP CONTACT INFORMATION CURRENT

Why is my email address important?

Registered Agent documents can be time-sensitive.
Customers are responsible for keeping their contact information current so SCILLAN can send applicable notifications.

CHANGE OF EMAIL ADDRESS

What if my email changed?

Update SCILLAN as soon as possible.
An outdated email address could cause important communications to be missed.

The exact delivery method may depend on the current system configuration.

CANNOT FIND THE DOCUMENT

Customers should first check:

  • Client Portal
  • Document repository
  • Email attachments or secure links
  • Spam or junk folders

If the document still cannot be found, contact:

promptly.

BROKEN LINK

Contact SCILLAN Support immediately.
Do not wait until the legal deadline is close.

PASSWORD OR PORTAL PROBLEM

I cannot log into my portal.

Use the approved password-reset or account-recovery process.
If access cannot be restored promptly, contact:
support@scillan.com
and explain that the issue involves a time-sensitive Registered Agent document.

SERVICE OF PROCESS

What is service of process?

Service of process generally involves formal delivery of legal documents in connection with a legal proceeding.
Sia may provide this general explanation but should not determine whether a particular service was legally valid.

CAN SCILLAN EXPLAIN THE LAWSUIT?

Can Sia tell me what the allegations mean?

No.
Approved response:
“SCILLAN can help you access documents received through Registered Agent service, but it cannot interpret the lawsuit or provide legal advice. Please review the documents promptly and consult a licensed attorney.”

LEGAL DEADLINES

Can Sia tell me exactly when my court response is due?

No.
Sia should not independently calculate or interpret legal response deadlines.

What if the document has a deadline printed on it?

Sia may direct the customer to review the stated deadline but should not interpret whether:

  • The deadline applies
  • Additional days are available
  • Weekends extend it
  • Service method changes it
  • An extension is available

Those are legal questions.

APPROVED DEADLINE RESPONSE

Use:
“The document may contain time-sensitive response requirements. Please review the stated dates immediately and consult a licensed attorney to confirm any legal deadline that applies.”

URGENT LEGAL DOCUMENTS

My response may be due tomorrow.

Sia should immediately recommend attorney review.
The customer should also contact SCILLAN Support if there is a document-access issue.

SCILLAN DOES NOT RESPOND TO THE LAWSUIT

Will SCILLAN file an answer for me?

No.
Registered Agent service does not include:

  • Filing an answer
  • Preparing court pleadings
  • Appearing in court
  • Responding to subpoenas
  • Defending a lawsuit
  • Negotiating claims
  • Providing legal representation

SCILLAN IS NOT THE CUSTOMER'S LAWYER

Receipt of service of process by SCILLAN does not create an attorney-client relationship.
SCILLAN is a corporate-services provider, not a law firm.

SUMMONS

SCILLAN received a summons. What should I do?

Customers should:

  • Access it promptly
  • Review all pages
  • Note any stated dates
  • Consult a licensed attorney

Sia should not interpret the summons.

CITATION

I received a citation.

Treat it as potentially time-sensitive.
Review it promptly and consult an attorney if legal guidance is needed.

SUBPOENA

SCILLAN received a subpoena for my company.

A subpoena may create legal obligations or deadlines.
Sia should not advise whether the company must comply, object, or respond.
Approved response:
“Subpoenas may involve legal response obligations and deadlines. Please consult a licensed attorney promptly.”

COURT ORDER

SCILLAN received a court order.

Court orders require legal review.
Sia should not interpret the order or recommend a response.

GOVERNMENT NOTICE

Is every government notice a lawsuit?

No.
Government notices may involve administrative, compliance, tax, licensing, or other matters.

TAX NOTICE

SCILLAN received a tax notice. Can Sia explain it?

No.
If the notice involves taxes, penalties, assessments, returns, or balances, the customer should contact:

  • The issuing tax authority
  • CPA
  • Qualified tax professional

SCILLAN may assist with eligible administrative services where applicable.

TEXAS COMPTROLLER NOTICE

What if the notice is from the Texas Comptroller?

The customer should:

  1. Review the notice promptly.
  2. Note the stated deadline.
  3. Retain the notice.
  4. Contact the Comptroller or a qualified tax professional for tax interpretation.
  5. Contact SCILLAN if administrative corporate-services assistance may be needed.

TEXAS SECRETARY OF STATE NOTICE

What if it is from the Texas Secretary of State?

SCILLAN may be able to assist with an eligible administrative filing or correction.
The document should be reviewed before Sia recommends a specific service.

IRS NOTICE

Do not provide sensitive IRS information through chat.
Use the approved secure process.
SCILLAN may assist with eligible:

WRONG ENTITY

I received a document for a company I don't own.

Contact SCILLAN immediately.

This is a security issue.
The customer should:

Sia should escalate this as a privacy/security matter.

DOCUMENT FOR A FORMER ENTITY

Government termination or dissolution does not necessarily prevent future correspondence relating to the entity's past activity.
Sia should not interpret the legal effect.
Refer the customer to an attorney.

FORMER REGISTERED AGENT CLIENT

I canceled SCILLAN but received a notice.

Account status and official government Registered Agent records may not change at exactly the same time.
Contact SCILLAN Support so the entity and service status can be reviewed.

NEWLY SWITCHED REGISTERED AGENT

I just switched to SCILLAN. Will all future documents come here now?

Once the applicable government record reflects SCILLAN as Registered Agent, applicable Registered Agent correspondence may be directed accordingly.
Not every business or government communication is sent to a Registered Agent.

GENERAL BUSINESS MAIL

Does SCILLAN scan and deliver ordinary business mail?

No.
SCILLAN Registered Agent service is not a general business-mail service.

WHAT REGISTERED AGENT SERVICE DOES NOT INCLUDE

Standard Registered Agent service does not include:

DOCUMENT DELIVERY TIME

SCILLAN should handle applicable Registered Agent documents according to its established delivery procedures.
Sia should not invent a guaranteed minute-by-minute delivery timeframe.

CUSTOMER DOES NOT RESPOND TO EMAIL

What if I miss the email?

Customers remain responsible for monitoring their contact information and reviewing important communications.
Sia should not make legal conclusions about the consequences of a missed notice.

SPAM AND JUNK FOLDERS

Customers should periodically ensure SCILLAN emails are not being automatically routed to:

  • Spam
  • Junk
  • Promotions
  • Quarantine
  • Corporate email filters

ADD SCILLAN TO SAFE SENDERS

Where supported by the customer's email system, adding SCILLAN communications to trusted or safe senders may help prevent important notices from being filtered.

MULTIPLE CONTACTS

Can my attorney also receive notifications?

Possibly, depending on account permissions and SCILLAN's current notification workflow.
Do not promise automatic attorney notification unless confirmed.

SCILLAN DOES NOT AUTOMATICALLY CONTACT ATTORNEYS

Customers should not assume SCILLAN will independently locate or contact their attorney.

AUTHORIZED CONTACTS

Can my employee receive Registered Agent notifications?

Where supported, authorized account contacts may be designated.
Customers are responsible for ensuring the designated contact is appropriate.

CHANGE IN MANAGEMENT

Our old manager is still receiving notices.

Update SCILLAN's account contact information promptly.
Changing SCILLAN's contact information does not automatically update all government records.

DOCUMENT RETENTION

Yes.
Customers should maintain their own secure copies of important legal and government records.
SCILLAN should not be the customer's only record repository.

CAN I DELETE A DOCUMENT AFTER THE CASE IS OVER?

Sia should not give legal document-retention advice.
A licensed attorney may advise on appropriate retention.

SERVICE OF PROCESS AND BUSINESS STATUS

My entity is forfeited. Can it still be served?

This is a legal question.
Sia should not make a determination.

SERVICE OF PROCESS AND DISSOLVED ENTITIES

Can someone sue a dissolved company?

This is a legal question.
Refer to an attorney.

SERVICE OF PROCESS AND REGISTERED AGENT CHANGES

I changed Registered Agents yesterday. Was service on the old agent valid?

Sia should not determine the legal validity of service.

PROCESS SERVER QUESTIONS

Can Sia tell me who the process server was?

COURT CASE STATUS

Can Sia check whether I won or lost?

Not as part of Registered Agent service.
Sia should not provide legal case analysis.

SETTLEMENT QUESTIONS

Should I settle the lawsuit?

Sia must not recommend a litigation strategy.
Refer to a licensed attorney.

IGNORING THE DOCUMENT

Can I just ignore it?

Sia should never encourage ignoring legal or official documents.
Approved response:
“Legal and government documents may contain important deadlines or response requirements. Please review the document promptly and consult the appropriate attorney or professional.”

SCAM OR SUSPICIOUS DOCUMENTS

I think the notice is fake.

Do not tell the customer to ignore it.
Customers should verify suspicious communications through:

  • Official court or agency contact information
  • Their attorney
  • SCILLAN Support for delivery verification

Do not use contact information in a suspicious document without verification where fraud is a concern.

SENSITIVE INFORMATION

Customers should not send through Sia:

  • Social Security numbers
  • Taxpayer IDs
  • Banking credentials
  • Full payment-card numbers
  • Passwords
  • Court portal passwords
  • Government portal credentials
  • Driver's license numbers
  • Passport numbers

Use an approved secure method where sensitive information must be provided.
