Is the legal entity name the same as a DBA?

A proposed entity name is the name a customer wants to use when forming a new business.
The proposed name remains subject to government acceptance.

Final name acceptance is determined by the applicable government agency.

NAME AVAILABILITY

Can Sia tell me whether a name is definitely available?

No.
Sia should not guarantee name availability.

Why can a name still be rejected?

A government filing authority may determine that a proposed name:

• Conflicts with an existing entity name
• Is too similar to an existing name
• Does not satisfy applicable naming requirements
• Requires additional information
• Cannot be accepted for another filing reason

Sia should not invent the specific reason without reviewing the actual filing or rejection.

Does an online search guarantee the name is available?

No.
A web search, Google search, domain search, or social-media search does not guarantee government name availability.

Does checking the Texas business database guarantee approval?

No.
A preliminary search may be useful, but the filing authority makes the final determination.

What happens if my proposed business name is rejected?

The customer may need to:

• Select another name
• Modify the proposed name
• Provide additional information
• Take another appropriate filing step

No, not automatically.

Can one LLC use more than one DBA?

Possibly.

Does a DBA require a new EIN?

Can SCILLAN search a business name for me?

WORDING AND SPELLING

Should I make sure the spelling is correct before filing?

Yes.
Customers should carefully review:

What if I notice a typo before filing?

Contact SCILLAN immediately so the information can be corrected before submission where possible.

What if I notice the typo after approval?
